Titre : Comparing Regulatory Agencies : Report on the results of a worldwide survey Type de document : document électronique Auteurs : Chris Hanretty, Auteur ; Christel Koop, Auteur Editeur : Florence [Italie] : Robert Schuman Centre for Advanced Studies (RSCAS) Année de publication : 2009 Importance : 27 p. ISBN/ISSN/EAN : 1028-3625 Langues : Anglais Catégories : DOCUMENTATION ORGANES DE REGULATION (SAUF CSA BELGE) Tags : Administration gouvernance regulation Index. décimale : 342.06 Droit administratif Note de contenu : "Although regulatory agencies have been created all over the world in the past decade, their design may vary considerably. In this report, we offer more insight into the variation in design by presenting the findings of a worldwide survey among regulators in seven policy areas: competition, energy, environmental, financial market, food safety, pharmaceutical and telecommunication policy. On the basis of the answers of 175 regulatory agencies from 88 countries, we conclude that although their design shows huge variation, a picture of the modal regulator can be drawn. The modal regulator is managed by a head and board members who serve for a fixed and renewable term of five years, who can be dismissed for reasons unrelated to their decisions, who cannot hold other offices in the public administration, and who need to be formally independent. The regulator is typically obliged to submit to politicians an annual report, whilst politicians can give the regulator policy instructions, can start an inquiry into the regulator’s operations, and can control the budget. Finally, the regulator is formally independent, has exclusive competence, decides on its own internal organisation and personnel policy, and makes policy decisions which cannot be reversed by another body than a court."

Titre : Monitoring media pluralism in Europe : testing and implementation of the media pluralism 2015 : policy report Type de document : document électronique Auteurs : Elda Brogi, Auteur ; Lisa Ginsborg, Auteur ; Alina Ostling, Auteur ; Pier Luigi Parcu, Auteur ; Maja Simunjak, Auteur Editeur : Florence [Italie] : Robert Schuman Centre for Advanced Studies (RSCAS) Année de publication : 2016 Importance : 88 p Langues : Anglais Catégories : MEDIAS Tags : concentration concurrence pluralisme régulation indépendance Europe Index. décimale : 302.23 Media Note de contenu : "According to MPM2015, Luxembourg presents low risk for the ‘Basic Protection’ and ‘Political Independence’ domains, respectively, a medium risk in terms of ‘Social Inclusiveness’ and high risk for the ‘Market Plurality’ domain. These mixed performances are mainly attributable to the small size of Luxembourg, its particular demographic structure (with a high percentage of non-Luxembourgish residents, who cannot be considered as “national minorities”), its prominent role in the international “market of concessions” and the lack of critical and independent reports on the national media legislation, market and practices. All in all, these special conditions explain that Luxembourg is a peculiar case where pragmatism defines the media and electronic communications policies. Pragmatism “justifies” the lack of human resources and the effectiveness of national authorities, the absence of an adequate national media offer (for the multilingual resident population), and the presence of a highly concentrated media market."
