It was adopted on 15 December 2015. ERGA calls on the Commission to revise the AVMSD in order to ensure the independence of audiovisual regulatory bodies. The Report provides recommendations on the characteristics of the independent regulatory authorities and asks the Commission to take them into account in the review of the AVMSD in order to foster the independence of regulatory authorities. The work of the subgroup was anticipated by the High Level Statement on the independence of NRAs in the audiovisual sector, which was approved on October 21, 2014, by the ERGA Plenary. The subgroup sent to all NRAs participating to ERGA a questionnaire aimed at collecting relevant information and data about the different national institutional set-ups regarding NRAs’ independence. The report summarizes the findings deriving from the analysis of the answers to the mentioned questionnaire and the position of the most relevant literature on the topic of “independence of regulators”, with the aim of providing the EU Commission with some ideas to foster the independence of regulators during the revision of the AVMS Directive. It also takes into consideration those provided by EPRA."
